LuviProtect Monitoring Terms & Conditions

By purchasing, installing, activating, or using LuviProtect products or monitoring services, the customer agrees to the following terms and conditions.

1. Monitoring Service Disclaimer

LuviProtect monitoring services are provided on a best-effort basis only.

LuviProtect does not guarantee the prevention of water damage, flooding, plumbing failure, freeze damage, burglary, unauthorized entry, fire, property damage, personal injury, business interruption, or any other loss or damage.

The customer acknowledges that the service may be affected by internet outages, electrical outages, cloud platform interruptions, hardware failures, software issues, sensor limitations, environmental conditions, WiFi issues, cellular network interruptions, customer configuration issues, delayed notifications, battery depletion, third-party service failures, or other circumstances beyond LuviProtect’s control.

The customer understands that LuviProtect is not an insurance company and does not provide insurance coverage of any kind.

2. Limitation of Liability

To the maximum extent permitted by applicable law, LuviProtect’s total liability for any claim, loss, or damage arising from the use of its products or services shall not exceed the total amount of monitoring fees paid by the customer during the previous six (6) months.

Under no circumstances shall LuviProtect be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages, including but not limited to:

– Water damage

– Mold damage

– Property damage

– Loss of use

– Loss of rental income

– Business interruption

– Plumbing damage

– Electrical damage

– Insurance-related losses

– Theft or burglary losses

– Personal injury

– Emotional distress

3. Customer Responsibilities

The customer is solely responsible for:

– Maintaining active internet connectivity

– Maintaining electrical power to all devices

– Maintaining proper plumbing systems

– Maintaining safe property conditions

– Replacing batteries where applicable

– Ensuring devices remain online and operational

– Periodically testing all devices and sensors

– Maintaining WiFi network functionality

– Updating emergency contact information

– Responding appropriately to alerts and notifications

– Maintaining all valves, pipes, fittings, and appliances

– Maintaining proper heating and environmental conditions

The customer acknowledges that failure to maintain any of the above may result in delayed alerts, missed notifications, or system failures.

4. No Emergency Response Guarantee

LuviProtect does not guarantee emergency dispatch, emergency response, immediate notification delivery, immediate technical support, or prevention of damage or loss.

Notifications may be delayed, interrupted, or fail due to internet outages, cloud service interruptions, mobile carrier issues, power outages, email filtering, spam filtering, SMS delays, software failures, or third-party service interruptions.

5. Hardware Warranty

LuviProtect hardware products include a limited one (1) year warranty against manufacturing defects only.

This warranty does not cover:

– Improper installation

– Water immersion

– Physical damage

– Cosmetic damage

– Battery depletion

– Environmental damage

– Power surges

– Lightning damage

– Customer misuse or abuse

– Unauthorized modifications

– Damage caused by freezing

– Damage caused by plumbing failures

Warranty claims may require product inspection and proof of purchase.

6. Return & Refund Policy

Hardware products may be returned within fourteen (14) days of delivery if returned in original condition.

Installation fees, activation fees, subscription fees, monitoring fees, shipping fees, and service charges are non-refundable.

Returned products that are damaged, modified, missing components, or improperly packaged may be refused or subject to restocking fees.

7. Service Interruptions

The customer acknowledges that monitoring services may occasionally become unavailable due to maintenance, software updates, cloud provider outages, internet failures, power failures, or circumstances beyond LuviProtect’s control.

Temporary interruptions do not constitute a breach of service.

8. Force Majeure

LuviProtect shall not be liable for any delay, interruption, or failure caused by events beyond its reasonable control, including but not limited to:

– Internet outages

– Electrical failures

– Severe weather

– Flooding

– Natural disasters

– Cellular network outages

– Cloud platform outages

– Cybersecurity incidents

– Labor disputes

– Government actions

– Supply chain interruptions

9. Acceptance of Terms

By purchasing, installing, activating, or using LuviProtect products or services, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.

If the customer does not agree to these terms, the customer must not use the products or services.
